Terms of Use

1. The agreement

These Terms of Use (“Terms”) are an agreement between you and Plonk, the independent game run by its developer Kevon (“Plonk”, “we”, “us”). They cover the game at play.plonk.land, the Plonk Android app (land.plonk.app) and plonk.land (together, the “Game”). By connecting a wallet, starting a demo, or otherwise playing, you agree to these Terms and to our Privacy Policy. If you do not agree, do not play.

2. Who can play

• You must be at least 18 years old and able to agree to these Terms.
• You must not play where the Game, crypto tokens or any of its features are against the law for you. You are responsible for following your local laws, including any rules on games of chance and on taxes.
• One person, one account at a time. The Game limits sessions per device and per household to keep it fair.

3. Your wallet

• Plonk is non-custodial. We never hold your tokens and never see your private key or seed phrase. In-game purchases are paid from your own wallet, which you sign yourself.
• You are responsible for your wallet, its security and every transaction you sign. Plonk staff will never ask for your seed phrase.
• A session token stays in your browser so you stay signed in. Use Settings → Disconnect wallet on shared devices.

4. Gold, items and tokens

• Gold, items, gear and other in-game things are not money and not your property. They are a limited licence to use content inside the Game. They have no guaranteed value, and we may change, rebalance or remove them.
• Payments are final. When you pay with $PLONK, SKR or another token, the transfer happens on the Solana blockchain and cannot be reversed by us. You pay the network fees. Check what you sign. If the Game fails to deliver something you paid for, contact us with the transaction signature and we will make it right.
• Rewards are not guaranteed. SOL boss bounties are paid only while the reward pool lasts. The gold buyback desk pays only while its wallet has funds, at a rate that moves and can drop, and it can pause or close at any time. Referral fee-share, bounties, airdrops, Seeker perks and other rewards are at our discretion, have limits and fraud checks, and may change or stop at any time. Rewards found to come from cheating, multi-accounting or bugs may be withheld or reversed in game.
• Not investment advice. Nothing in the Game, our posts or our community is financial, investment, legal or tax advice. $PLONK and other tokens are volatile and can lose all their value. Do not spend more than you can afford to lose. Do not play to make money.
• Prices shown in the Game (USD estimates, gold prices, exchange rates) are estimates from third-party sources and may be wrong or out of date.

5. Rules of conduct

Chat, names, custom skins and anything else players create (“Player Content”) must follow these rules. You must not post, upload, say or use as a name anything that:

• is illegal, or promotes illegal activity (including drugs, theft or violence);
• is hate speech, or threatens or incites hatred or violence against people based on race, ethnicity, religion, disability, sex, gender identity, sexual orientation or similar characteristics;
• harasses, bullies or threatens another player;
• promotes self-harm or suicide, or real-world violence or dangerous acts;
• is sexually explicit, pornographic or involves prostitution; or sexualises minors in any way;
• infringes someone else’s copyright, trademark or other rights (for example, a skin copied from someone else’s art without permission);
• impersonates Plonk staff, Solana Mobile or any other person or company, or falsely claims an endorsement;
• is a scam, phishing, a fake giveaway, an attempt to get someone’s seed phrase, or a token contract address other than the official $PLONK one;
• is spam, advertising, or false or misleading health claims.

You must also not cheat, bot, exploit bugs, run several accounts to farm rewards, attack or overload the servers, or interfere with other players’ games. Report bugs instead of using them.

You keep the rights you have in your Player Content, but you give us a free, worldwide licence to host, show and distribute it inside the Game and its stream and promotion, and to remove it.

6. Reporting, blocking and enforcement

• Block: tap a player (or their chat line) and choose Block. You will no longer see their chat or get their invites. Manage your list in Settings → Blocked players.
• Report: tap a player or chat line and choose Report. The report goes to Plonk staff with the recent chat lines as context.
• We moderate Player Content and may remove it. Depending on how serious it is, we may warn you, mute your chat, remove your messages or skin, freeze (temporarily lock) or ban an account, and withhold rewards gained by breaking these Terms.
• Disputes: if you disagree with a decision, or have a problem with another player or a purchase, first use Settings → Report a bug / Send feedback. Staff can reply to you inside the game. If that does not solve it, email polskimcduck@gmail.com and we will try in good faith to resolve it.

7. Chance-based mini-games

Some mini-games use random outcomes. Outcomes are decided by the server, odds can include a house edge, and you can lose what you put in. Play them for fun only, and only where this is legal for you. We may limit, change or switch them off, including in some regions or versions of the app.

8. Ending your account

You can stop playing at any time and delete your account with Settings → Delete my account (see the Privacy Policy for what is deleted and kept). We may suspend or end access for anyone who breaks these Terms or puts other players or the Game at risk. We may change, pause or shut down the Game or any part of it at any time. Sections 4, 9, 10, 11 and 12 survive.

9. Our content

The Game, its code, art, music, names and logos belong to Plonk or its licensors. We give you a personal, non-exclusive, non-transferable, revocable licence to play the Game for your own fun under these Terms. Do not copy, resell, reverse engineer or build bots or tools against it, except where the law allows.

10. Disclaimer of warranties

THE GAME IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLONK AND THE SOLANA MOBILE PARTIES DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE GAME WILL BE UNINTERRUPTED, ERROR-FREE, SECURE OR AVAILABLE IN YOUR JURISDICTION, THAT ERRORS WILL BE FIXED, OR THAT ANY REWARD, PRICE OR TOKEN WILL KEEP ANY VALUE. NEITHER PLONK NOR THE SOLANA MOBILE PARTIES ARE RESPONSIBLE FOR LOSSES CAUSED BY WALLETS, SMART CONTRACTS, THE SOLANA NETWORK OR OTHER BLOCKCHAINS (INCLUDING FORKS, CONGESTION, NODE ISSUES OR FAILED TRANSACTIONS), OR BY THIRD-PARTY SERVICES.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PLONK NOR THE SOLANA MOBILE PARTIES WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, TOKENS, IN-GAME ITEMS OR USE, ARISING FROM OR RELATING TO THE GAME OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY, AND INCLUDING DAMAGES CAUSED BY FORCE MAJEURE OR BY THIRD PARTIES. THE SOLANA MOBILE PARTIES HAVE NO LIABILITY TO YOU AT ALL IN CONNECTION WITH THE GAME. PLONK’S TOTAL LIABILITY FOR ALL CLAIMS IS LIMITED TO THE GREATER OF (A) WHAT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AND (B) USD 50. IF YOU ARE DISSATISFIED WITH THE GAME, YOUR SOLE REMEDY IS TO STOP USING IT. SOME PLACES DO NOT ALLOW SOME OF THESE LIMITS; THEN THEY APPLY ONLY AS FAR AS THE LAW ALLOWS, AND NOTHING HERE LIMITS RIGHTS YOU HAVE THAT CANNOT BE WAIVED.

12. Solana Mobile and app stores

If you got the Game from the Solana Mobile dApp Store: these Terms are between you and Plonk only. Solana Mobile, Inc. and its affiliates, officers, employees and agents (the “Solana Mobile Parties”) are not a party to these Terms and have no responsibility or liability to you in connection with the Game, its content, its maintenance and support, or any claim about it. Plonk, not the Solana Mobile Parties, is responsible for the Game.

13. Changes to these Terms

We may update these Terms. We will change the date and version above, and the Game will show you the new version when the change matters. If you keep playing after that, you accept the new Terms.

14. General

If part of these Terms cannot be enforced, the rest still applies. Not enforcing a rule is not a waiver. You may not transfer these Terms; we may transfer them with the Game. These Terms and the Privacy Policy are the whole agreement between you and us about the Game.
